These Terms and Conditions set out the basis on which Rubbish Removal South Kensington provides waste and rubbish collection services to residential and commercial customers. By placing a booking with us, you agree to be bound by these Terms and Conditions. Please read them carefully before making a reservation for any rubbish removal or waste collection service.

Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Company means Rubbish Removal South Kensington, the provider of rubbish removal and associated services.

Customer means any individual, business, organisation or other entity that requests or receives services from the Company.

Services means any rubbish removal, waste collection, clearance, loading, transportation, recycling or disposal work carried out by the Company.

Booking means a request made by the Customer, and accepted by the Company, for the provision of Services at a specified date, time and location.

Site means the address or premises where the Services are to be carried out.

Waste means any items, materials or rubbish that the Customer requests the Company to collect and remove, subject to applicable waste regulations.

Scope of Services

The Company provides rubbish removal and waste collection services, including but not limited to household waste clearances, office and commercial clearances, bulky item removal, garden waste removal, and general rubbish collection. The exact scope of the Services to be delivered will be agreed at the time of Booking and confirmed in writing or via electronic communication where possible.

The Company reserves the right to refuse to collect particular items or materials that are prohibited, hazardous, or not suitable for transport or disposal under applicable waste laws and regulations. Examples may include certain chemicals, clinical waste, asbestos, gas cylinders, and other dangerous substances.

Booking Process

Customers may request a Booking by telephone, email or online contact form where available. When making a Booking, the Customer must provide accurate and complete information, including:

1. The full address of the Site where the Services are required.
2. A description and approximate quantity or volume of the Waste to be removed.
3. Details of any access restrictions, parking limitations or special conditions at the Site.
4. Preferred dates and time windows for the Service to be carried out.
5. Relevant contact details for the person responsible at the Site on the day of collection.

Any quotation provided by the Company is based on the information supplied by the Customer at the time of the Booking. The Company reserves the right to amend any quotation and adjust the charges if the volume, type or nature of the Waste, or the access conditions at the Site, differ materially from the Customer’s description.

A Booking will be deemed confirmed when the Company has acknowledged acceptance of the request and, where required, received any applicable deposit or pre-payment. The Company will use reasonable endeavours to attend the Site at the agreed time, but all dates and times are estimates and are not guaranteed.

Access and Site Requirements

The Customer is responsible for ensuring that the Company has safe, suitable and lawful access to the Site for the duration of the Services. This includes arranging any necessary parking permits, permissions to enter the premises, and ensuring that driveways, entrances and internal areas are reasonably clear to allow the Company’s staff to carry out their work safely.

If adequate access is not available, or if the Site is deemed unsafe by the Company’s staff, the Company may refuse to perform some or all of the Services. In such a case, the Customer may still be liable for call-out or cancellation charges.

The Customer must ensure that any fragile, valuable or personal items that are not intended for removal are clearly separated from the Waste. The Company will not be responsible for any items removed in error where they were not reasonably identifiable as items to be retained.

Pricing and Quotations

Prices for rubbish removal and waste collection are usually based on factors such as the estimated volume and weight of the Waste, the type of material, access and loading conditions, labour required, and any applicable disposal, recycling or landfill charges. The Company may provide indicative pricing over the phone or electronically, which is subject to confirmation once the team attends the Site and inspects the Waste.

If the actual Waste or Site conditions differ from the original description, the Company will inform the Customer of any change in price before commencing the work. If the Customer does not agree to the revised charge, the Company may decline to carry out the Services, and a call-out fee or cancellation charge may apply.

All prices quoted are exclusive of any applicable taxes or governmental charges unless expressly stated otherwise. The Customer is responsible for paying any such taxes that may apply.

Payments

Unless otherwise agreed in writing, payment is due immediately upon completion of the Services. The Company may accept payment by cash, debit card, credit card, bank transfer, or other methods notified to the Customer at the time of Booking.

For certain Bookings, the Company may require a deposit or full pre-payment before attending the Site. If the Customer fails to pay any amount due on time, the Company reserves the right to charge interest on the overdue sum at the maximum rate permitted under applicable law, as well as reasonable administration and recovery costs.

Where Services are provided to a business Customer, the Company may, at its discretion, agree to issue an invoice payable within a specified period. The Customer must pay all invoices in full without any set-off, counterclaim or deduction.

Cancellations, Rescheduling and No-Show

The Customer may cancel or reschedule a Booking by providing notice to the Company. The following provisions apply in relation to cancellations and rescheduling:

1. If the Customer cancels or reschedules more than 24 hours before the agreed arrival time, the Company will generally not charge a cancellation fee, unless special arrangements or costs have already been incurred.
2. If the Customer cancels or reschedules less than 24 hours before the agreed arrival time, the Company may charge a cancellation fee, which may include any lost labour costs, vehicle costs or other expenses.
3. If the Customer fails to provide access to the Site at the agreed time or is not present where required to authorise the work, the Company may treat the Booking as cancelled and charge a no-show or call-out fee.

The Company reserves the right to cancel or reschedule a Booking at any time due to circumstances beyond its reasonable control, including but not limited to vehicle breakdown, staff illness, severe weather, traffic disruption, safety concerns, or compliance with legal obligations. In such cases, the Company will use reasonable efforts to notify the Customer and arrange an alternative time. The Company will not be liable for any indirect or consequential loss arising from such cancellation or rescheduling.

Customer Obligations

The Customer agrees to:

1. Provide accurate information about the Waste and Site conditions at the time of Booking.
2. Ensure safe and lawful access to the Site for the Company’s staff and vehicles.
3. Separate any items not intended for removal and clearly indicate which materials are to be collected.
4. Comply with any reasonable instructions from the Company’s staff in relation to safety, access and the performance of the Services.
5. Not include in the Waste any items that are prohibited or unlawful to transport or dispose of under applicable regulations.

If the Customer breaches any of these obligations, the Company may suspend or terminate the Services and may recover from the Customer any additional costs or losses incurred as a result.

Waste Regulations and Prohibited Items

The Company will manage and dispose of collected Waste in accordance with applicable UK waste management laws and regulations. This includes compliance with the duty of care in relation to waste, and the requirement to transport and dispose of waste only at authorised facilities.

The Customer must not present for collection any hazardous or special waste unless this has been expressly agreed in advance and the Company is properly licensed and equipped to handle such materials. Prohibited or restricted items may include, without limitation, asbestos, clinical waste, chemicals, solvents, oils, gas bottles, explosives, and certain electrical or electronic equipment where special processing is required.

If the Company’s staff discover that the Waste includes items that are unlawful or pose a risk to health, safety or the environment, the Company may refuse to remove such items and may, at its discretion, terminate the Services or adjust the charges to reflect any additional handling or disposal requirements.

Liability and Limitations

The Company will exercise reasonable care and skill in providing the Services. However, the Company’s total liability to the Customer, whether in contract, tort including negligence, or otherwise, arising in connection with the Services, shall be limited to the total price paid or payable for the specific Booking giving rise to the claim.

The Company shall not be liable for any indirect or consequential losses, including but not limited to loss of profit, loss of business, loss of opportunity, or any loss arising from delays, cancellations or rescheduling, except where such exclusion is not permitted by law.

Nothing in these Terms and Conditions shall exclude or limit the Company’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

The Customer is responsible for ensuring that any property or fixtures that may be at risk of damage during the rubbish removal process are adequately protected or removed from the immediate work area. While the Company will act with reasonable care, it shall not be liable for cosmetic damage to walls, floors, doors, or other surfaces caused by moving bulky or heavy items through confined spaces, where such damage is reasonably foreseeable and cannot be avoided.

Insurance

The Company maintains insurance cover appropriate for the nature of its rubbish removal and waste collection operations. Details of insurance arrangements may be provided to the Customer upon reasonable request.

The Customer is responsible for maintaining any insurance necessary for their own property, including cover for accidental damage, loss of personal items, or other risks not expressly assumed by the Company in these Terms and Conditions.

Complaints and Disputes

If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as reasonably practicable, giving details of the issue and allowing the Company a fair opportunity to investigate and, where appropriate, remedy the situation.

The Company aims to address complaints promptly and fairly. In the event that a dispute cannot be resolved between the parties, either party may consider seeking independent advice or utilising appropriate alternative dispute resolution processes.

Force Majeure

The Company shall not be in breach of these Terms and Conditions nor liable for delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control. Such events may include, but are not limited to, extreme weather, natural disasters, strikes or industrial disputes, war, terrorism, breakdown of plant or machinery, or failure of utility services.

If a force majeure event continues for a period exceeding 30 days, either party may terminate the affected Booking upon written notice to the other party.

Data Protection and Privacy

The Company may collect and process personal data relating to the Customer in order to manage Bookings, provide Services, process payments and handle customer enquiries. The Company will handle such personal data in accordance with applicable data protection laws and will take reasonable steps to safeguard it from unauthorised access or disclosure.

By making a Booking, the Customer consents to the Company using their contact details for the purposes of administering the Services and communicating relevant information. The Customer may request access to, or correction of, their personal data held by the Company, subject to legal limitations.

Changes to Terms and Conditions

The Company reserves the right to amend or update these Terms and Conditions from time to time. Any changes will take effect when published or otherwise communicated to the Customer and will apply to Bookings made after that date. The version of the Terms and Conditions in force at the time of a Booking will continue to apply to that Booking.

Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation issued by the Company, constitute the entire agreement between the Customer and the Company in relation to the Services. The Customer acknowledges that they have not relied on any statement, promise or representation that is not set out in these Terms and Conditions.

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

By proceeding with a Booking and allowing the Company to commence the Services, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
